Californians fed up with being charged for ending their cell phone service prematurely won a major victory in a Bay Area court decision that concluded such fees violate state law. In a preliminary ruling Monday, Alameda County Superior Court Judge Bonnie Sabraw said Sprint Nextel must pay California mobile-phone consumers $18.2 million as part of a class-action lawsuit challenging early termination fees. Though the decision could be appealed, it's the first in the country to declare the fees illegal in a state and could affect other similar lawsuits, with broad implications for the nation's fast-growing legions of cell phone users. The judge - who is overseeing several other suits against telecommunications companies that involve similar fees - also told the company to stop trying to collect $54.7 million from other customers who haven't yet paid the charges they were assessed. The suit said about 2 million Californians were assessed the fee. Whether Sabraw's ruling will stand isn't clear. Experts say an appeal is likely, and the Federal Communications Commission is considering imposing a rule - backed by the wireless industry - which might decree that only federal authorities can regulate early termination fees. Sprint Nextel also argued in the lawsuit that such fees - which ranged from $150 to $200 - were outside the purview of California law. But Sabraw rejected that argument. "This is a terrific ruling," said Chicago attorney Jay Edelson, who was not part of the case but has filed about 50 other suits nationwide against various cell phone charges. "The phone companies have a tremendous amount of power," he added. "They lock you into long-term contracts and then they allow all these charges to be put on your bill. We have to make sure that consumers are protected." "We are disappointed," said Sprint Nextel spokesman Matthew Sullivan. But he added that Sabraw's ruling was tentative and that she has given Sprint Nextel's attorneys the opportunity to file a rebuttal before she considers making it permanent. Sullivan noted that similar suits have been filed in other states, but that Sabraw's decision was the first he knows of declaring such fees illegal. Several other industry experts agreed, including John Walls, a spokesman with the CTIA, a Washington-based organization that represents the wireless telecommunications industry. "I don't know of any state that has gone to this extent," he said, adding that his group believes it makes more sense to have such fees solely policed by the federal government. 'National framework' "A consistent, uniform, national framework of standards is the best-case scenario for consumers and for the industry to serve consumers," he said. "If you allow 50 states to regulate and legislate in 50 different ways, you can create a very confusing and obviously inefficient service." At a public hearing last month, FCC Chairman Kevin Martin sketched out a plan in which cancellation fees would be reduced over the life of the cell phone contract. Three companies - T-Mobile, AT&T and Verizon Wireless - already do that, and Sprint said it would begin prorating its fees next year. The commission also is trying to resolve whether states have any role in regulating early termination fees, which are among the biggest source of complaints among wireless consumers, said spokesman Robert Kenny. Fees or 'rates'? He said the agency may decide to define such fees as "rates," which are subject to federal regulation under federal law. But if that happened, it is unclear how that might affect lawsuits in California and other states, Kenny said. "That is something that will have to be addressed," he added, noting that the FCC hopes to resolve the issue by the end of the year. Chris Murray, senior legal counsel for Consumers Union, said he hoped the California court decision would "drive a stake through the heart" of the industry's desire to remove state courts and state regulators from overseeing the fees. That view was seconded by Scott Bursor, a lawyer for the victorious Sprint Nextel customers, who said the FCC likely would be persuaded by Sabraw's logic that states should have a role in policing the fees. If the FCC does limit state oversight, "it will get reversed" by the courts, he added. On June 12, a jury in the Alameda County lawsuit ruled in favor of Sprint Nextel, determining that its customers who canceled their service early had breached their contracts with the company and that early termination fees were warranted. But in overruling that decision, Sabraw said the jurors appear to have erred in assuming the fees were valid, and she took issue with the way Sprint Nextel determined that its customers owed the fees. "Sprint did no damage analysis that considered the lost revenue from contracts, the avoidable costs and Sprint's expected lost profits from contract terminations," she said. Nonetheless, Sabraw preserved a portion of the jury's verdict and used that to scale back the amount of refunds the suit initially had sought.

LOS ANGELES, California (CNN) -- The AIDS epidemic among African-Americans in some parts of the United States is as severe as in parts of Africa, according to a report out Tuesday.
"Left Behind - Black America: A Neglected Priority in the Global AIDS" is intended to raise awareness and remind the public that the "AIDS epidemic is not over in America, especially not in Black America," says the report, published by the Black AIDS Institute, an HIV/AIDS think tank focused exclusively on African-Americans.
"AIDS in America today is a black disease," says Phill Wilson, founder and CEO of the institute and himself HIV-positive for 20 years. "2006 CDC data tell us that about half of the just over 1 million Americans living with HIV or AIDS are black."
Although black people represent only about one in eight Americans, one in every two people living with HIV in the United States is black, the report notes.
The report uses just-released data from UNAIDS and existing CDC and Census data to highlight grim statistics:

"Five percent of the entire population (in DC) is infected... that's comparable to countries like Uganda or South Africa," Dr. Anthony Fauci, director of the National Institute of Allergy and Infectious Diseases, told CNN for the recent "Black in America" documentary.
According to this report, if black Americans made up their own country, it would rank above Ethiopia (420,000 to 1,300,000) and below Ivory Coast (750,000) in HIV population. Both Ethiopia and the Ivory Coast are among the 15 nations receiving funds from the President's Emergency Plan For Aids Relief. The United States has given about $15 billion to PEPFAR nations in the past five years. Tell us: What's your experience being black in America?

Wilson says more needs to be done to prevent the spread of HIV in this country. The report states that the U.S. government "increased spending on HIV prevention, treatment and support programs for low-income countries dramatically, at the same time that domestic remained all but flat." In this report, Wilson and others urge the federal government and private foundations to significantly increase funding for HIV prevention and treatment programs. The report also calls on international agencies to hold the U.S. government accountable for failure to address HIV/AIDS epidemic in its own country (despite lauding it for its PEPFAR efforts). It also urges black communities in the United States to fight the stigma and overcome prejudice associated with being infected with HIV.
"Peggy" found out 10 years ago that she was HIV positive. The fact that she's asked us to not use her real name is an example of the stigma that's still attached to having the virus that causes AIDS, especially in the African-American community.
"I don't really talk to many other people about it, 'cause I guess maybe, they don't want to talk," says the 27-year-old Lake Charles, Louisiana, woman. Others like her, she says, are still too ashamed to admit they have HIV. AC 360 Blog: The cavalry is not coming to save us
Marvelyn Brown, 24, of Washington, is more open about her status. She learned she had HIV when she was only 19, after one time of unprotected sex while in a monogamous relationship.
Brown has told her story in a book, "The Naked Truth, " and to CNN in last week's special report, "Black in America." She regularly addresses community groups, trying to help educate blacks about the risk of of HIV and AIDS.
The report was funded by the Ford Foundation and the Elton John AIDS Foundation.

When will PINK add TU to the distro?

Now this may not matter to many of you guys on the distro, but when PINK added a college line I was pissed to not see any HBCUs. I did my thing and just started continually submitting Tuskegee University on their online page which stated, don't see you school, submit them.

Well I see that another African American young woman took it a bit more seriously. I'm happy she did so, but I'm still pissed that the #1 HBCU in Alabama and #6 in the Nation has not made the list. I'll be sending my LETTER in soon, but first a letter to TU to make sure they aren't going to cause no drama with the lincensing agreement with PINK!

Collegiate apparel to showcase black colleges

July 24, 2008 -- When Victoria's Secret Pink rolled out its nationwide collegiate collection in June, featuring the names and logos of some 33 universities on sweats, hoodies, football tees, and totes, the promotion didn't include any historically black colleges and universities (HBCUs). This fall, the brand plans to include five HBCUs in the second phase of its collegiate collection.

But, for Amelia Reid, a sophomore at Howard University and a Pink fan, the initial omission was hard to take.

"Going to Howard, where the students are very into academics and also into fashion, I thought 'Wow, this is crazy,'" says Reid, who is studying political science and fashion merchandising. "Here is another company that doesn't acknowledge black colleges. A lot of girls from Howard wear Victoria's Secret and work there also. It shouldn't have been just those typical schools that come to mind when you think of college."

Reid e-mailed Victoria's Secret to express her dismay and was upset when she received a response that she describes as "sugar-coated" and dismissive. Her disappointment materialized into a crusade to bring Pink onto the campuses of HBCUs. Early in July, she started a Facebook group "HBCU Ladies Wear Victoria's Secret Pink Too" in an effort to encourage people to write to the company and complain about the HBCU oversight. By late July, the group had more than 400 Facebook members.

A few days after Reid's initial e-mail, Richard A. Dent III, chief operating officer for Pink, contacted Reid through her Facebook group after someone forwarded him her complaint. "I reached out to her because she was a fan of the brand. I wanted her to know that we were not being insensitive, and we did have a plan," says Dent, a graduate of Florida A&M University's business school and a member of the school's board of trustees.

According to Dent, the first HBCU schools that will roll off the Pink line will be Howard University, Florida A&M University, Hampton University, North Carolina A&T University, and Southern University. "We have agreements with the licensees who handle collegiate apparel for those schools, and this has been in the works for some time," he says. Dent adds that the company plans to include students from the schools in internships at Victoria's Secret, and feature promotions at their homecoming events.

Pink, a collection of loungewear geared toward young, college-aged women, first appeared in Victoria's Secret stores in 2004. Since then, the brand has solidified its success within the parent company, Limited Brands, a retailing behemoth that includes Bath & Body Works and Henri Bendel. Dent says he didn't view Reid's Facebook group negatively. "We encourage people to be vocal [about our product]," he says. "Victoria's Secret and Pink's mission is to have relationships with our customers."

Pink used the size of the university's undergraduate and alumni population, geographical reach, and revenue from royalty sales to determine which schools would be included in the initial roll out, but Dent says that it was always his intention to eventually include HBCUs.

Using school size as criteria for the first round automatically excludes minority populations without considering their spending potential, says Bob Dale, CEO of Chicago-based R.J. Dale Advertising & Public Relations Inc. "They might have been a little short-sighted."

"In terms of distribution through Victoria's Secret's website and catalog in millions upon millions of homes it will be a wider distribution than [HBCUs] have ever enjoyed in any other licensed program," says Scott Bouyack, vice president of apparel marketing at the Collegiate Licensing Co.

Not using an HBCU in the first phase "sparks some interesting conversation," says Tina Wells, CEO of Buzz Marketing Group, who joined Reid's Facebook's group. "Victoria's Secret has been very good to women like Tyra Banks and Latino models. I think we should look at the company's history when it comes to African Americans, and I don't feel that exclusion is characteristic to who the company is."'

"Black consumers are loyal to those companies and brands that are loyal to them," says McGhee Williams Osse, co-CEO of Burrell Communications. "African American consumers want to be recognized and respected by corporations where we spend money, and those corporations [must remember] that they are competing for our dollars."

"I can't say that it was unfair," Osse adds. "Clearly it was a business decision, and Victoria's Secret is in the business to make money. I know that we spend more, buy more frequently, and in casual wear, we buy more garments per purchase."

All agree that the Pink brand and all other retailers can't just compare population numbers. They maintain that companies need to look at the buying behavior of these young women, particularly African American women, who are graduates of these schools.

"From a trend standpoint, I would say [black schools are] a very viable audience for Victoria's Secret," Osse says. "It is the type of retail operation that young, socially active, fashion-involved, African American women would be attracted to. I think this oversight is very unfortunate."

As for Reid, she doesn't plan to patronize the company until she sees its promotional tour bus at Howard's homecoming and HBCU products on the racks. "I hope my site's feedback shows that young black girls are major consumers of Victoria's Secret," Reid says. "When I can actually pick up my Howard sweatpants, is when I'll buy Pink again."

HALTOM CITY — A young local rap artist was sentenced to 30 years in prison Wednesday for killing another local rapper in 2006 after a rap battle escalated into a fight at a field.
Samuel Raynard Jones, 20, pleaded guilty Wednesday in a Fort Worth courtroom to engaging in organized criminal activity.
Jones fatally shot 17-year-old Christopher Smith on Sept. 15, 2006 in a field in the 5700 block of Diamond Oaks Drive South in Haltom City.
Smith had arrived at that field along with some friends to participate in a rap battle --a hip-hop tradition in which rappers face off in impromptu contests of rhyming skills.
Smith and Jones faced off until Jones pulled a handgun, according to an arrest warrant affidavit. Smith suggested the two fight with fists, and Jones agreed, Haltom City police said. The two wrestled a short time until witnesses broke up the fight when Jones began choking Smith, the affidavit states.
Smith was collecting his belongings when Jones shot him in the head, according to the affidavit.
Jones was arrested Sept. 23, 2006 at a hotel near Beach Street and Loop 820.
At the time of the shooting, Jones had been on probation on drug and deadly conduct charges, according to Tarrant County criminal court records.
On Wednesday, he was sentenced to five years in prison for probation violation on the deadly conduct charge and 10 years for probation violation on the drug possession charge. All the sentences will run concurrently, according to court records

Behind the Scenes: Black and shopping in America

For the past 18 months, CNN's Soledad O'Brien has been working on "CNN Presents: Black in America" which airs July 23 and 24, at 9 p.m. ET.
(CNN) -- For Atlanta native Leah Wells, it's the humiliation she remembers most.
Not long ago, Wells sent me a note and forwarded a letter she had just mailed to Glenn Murphy, chairman and CEO of Gap Inc. The letter detailed what happened when Wells and two girlfriends decided to ditch the gym during an office lunch break and do some "power-shopping" instead. The three young women, all in their 20s and all black, ended up detained for shoplifting.
"We were dressed professionally," Wells told me. "It was casual Friday. We had on dresses and casual office wear. We were racially profiled. It was as simple as that."
Wells says she and her friends were detained by six Gwinnett County, Georgia, police officers for "about an hour and a half" at the entrance of an Old Navy store, owned by Gap. Their crime, as Wells sees it, was being black in America.
In her letter to Murphy, Wells describes enduring "disdainful stares from the mothers and grandmothers and children entering the store." Police responded to a call from mall security about a gang of shoplifters in the store. They found no stolen merchandise on Wells or her friends. No one -- not the police, not the store managers -- bothered to apologize.
"No matter your education, your status or profession, some still only see the color of your skin," Wells wrote two months after the event.
Sad to say, but it's a common refrain from black people in this country. All of us know someone who has, or have ourselves, been stopped for no apparent reason while driving or been searched for fitting a description.
It happened to my brother Orestes. A Harvard medical student at the time, he was visiting a friend in Brooklyn, New York, when he was stopped and searched by officers late one night. He "fit the profile" of a robbery suspect. They dumped his belongings in the street and made him lie face-down. What infuriated him was that no apology ever followed when it became clear the cops got it wrong. It seemed no one felt that one was owed. My brother was seething when he told me the story. It happens all the time.
And it happens across the geographic and socioeconomic spectrum: rich, poor and in between. What surprised me most often during our production of "Black in America" were the universal stories of blacks followed or profiled. It was shocking to me. iReport.com: Share your experiences
So many parents told me of sitting down with their sons starting at 12 years old to tell them what to do if pulled over by the police so as not to get shot. I don't imagine many white parents even think such a conversation is necessary with their teenage sons.
We've spent the past 18 months trying to accurately tell the story of black people in this country, a story rarely told with the depth and fullness it requires. Black people are seen frequently as rappers and "ballers" and sometimes exceptional, like Secretary of State Condoleezza Rice. But coverage of the vast black middle class is nearly nonexistent. What's the impact of that on America? What's the impact of that on young black kids who don't see themselves in mainstream media associated with academic achievement, success, hard work? It's hard to know, but it cannot be good.
I'm the product of a white father who's Australian and a black mother who's Cuban. They married in the United States in 1958 but had to leave their neighborhood of Baltimore, Maryland, because interracial marriage was illegal in that state. By the time my little brother Orestes was born in 1967 -- the sixth O'Brien child -- the Supreme Court finally changed the law and lifted the ban on interracial marriage. When I tell that story in speeches, older folks in the audience nod their heads while younger ones gasp. It was illegal for my parents to marry, and it wasn't all that long ago.
Black and white people need to talk about our shared history -- policies that have held some people back, opportunities that some have not sought. My sense is the time is right for this dialogue on race. With a black man running for president Americans are talking about race every day. Watch how documentary brought viewer to tears »
Leah Wells tells me she is "coming to an understanding" with Gap. When I contacted Gap myself, a spokesperson told me that an internal investigation led to the firing of a manager. Later she e-mailed this statement: "We realize it's probably too late. We regret that we did not apologize for what these ladies experienced at our store, and this goes against everything we stand for as a company."
Wells has decided to not only get mad but get active, writing and talking about what happened to her and her friends on a day they just set out to do some shopping.
Making a change is not for the weak willed. Our documentary "Black in America" will make you proud and angry, hopeful and frustrated. Please, go out and DO something about what you're seeing and feeling. Give your money, give your time, write op-eds, commit to changing the part of reality that's not good.

Alan and Susan Raymond spent one year filming in Frederick Douglass High School, which has a rich history of successful alumni, including Supreme Court justice Thurgood Marshall. Shot in classic cinema verité style, the film captures the complex realities of life at Douglass, and provides a context for the national debate over the controversial No Child Left Behind Act, focusing on the brutal inequalities of American minority education, considered an American tragedy by many.
Douglass principal Isabelle Grant oversees a staff of teachers that is two-thirds non-certified, while many are substitutes unqualified to teach their subject areas. Threatened with sanctions, or even closing, unless student scores improve in annual standardized tests, the faculty tries to find workable solutions to chronic problems of attendance, lateness and apathy among students, many of whom come from poor backgrounds and broken homes, and lack the most basic reading and math skills.
Due to an achievement gap of four to five years below grade level, ninth grade students present the greatest challenge, requiring intensive intervention by the already overwhelmed teaching staff. By the end of the school year, 50% will drop out. Grant and her staff struggle to raise state assessment scores as a Maryland State monitor continually watches over Douglass with the threat of a state takeover.
At the same time, there are reasons for hope. The high school boasts an award-winning music program, named after Douglass graduate and jazz great Cab Calloway, that includes a choir, a drumline marching band, a jazz combo and an orchestra. The basketball team was Maryland State champion two of the last three years. And the outstanding debate team consistently wins trophies at the Baltimore Urban Debate League. Students Sharnae, Jordan and Matt tell stories of struggling to overcome the enormous challenges of splintered families and peer pressure as they navigate their high school days, offering a reminder that education is inevitably an achievement of people, not policy. With the support of Douglass, these students have demonstrated resilience in the face of formidable odds.
Eventually, Douglass fails to make the adequate yearly progress required by the No Child Left Behind Act and the city and state wrestle for control of the school. This is typical of inner-city schools that cannot meet the demands of the federal law. By 2007 one in four of the nation's public schools failed to show improvement under the No Child Left Behind Act and was threatened with sanctions.

Devin The Dude Signs With Razor & Tie

After perusing the first half of this year as a free agent, Devin The Dude [click to read] has finally decided on a label to call home in Razor & Tie.
A New York-based record label, Razor & Tie and Devin The Dude agreed upon a one-album deal that will subsequently be released later this fall, according to Billboard.com. The album, entitled Landing Gear, will be his fifth studio album and will feature production from longtime collaborators The Coughee Brothaz.
Known for being a more Rock-oriented label, has also released albums in Hip Hop such as Prince Paul's Politics of Business. Devin The Dude felt the move was right regardless of this aspect. “Koch was interested but I chose to go with Razor [& Tie] because they made it easy and the numbers were right. While I wouldn't want to stand in line, waiting for my project to come out behind other artists, I wouldn't mind a larger label. Razor & Tie just came with a cool proposition.”
This “cool proposition” includes a tentative 30-state college tour in October which will be his main marketing tool for Landing Gear. Also, Razor & Tie will give Devin The Dude creative freedom in pursuing side projects with other artists, a perk that no major label would allow him.

Gannett News Service WASHINGTON — Jawad Khaki came to America for justice and freedom. But he says he doubts those ideals after U.S. customs officials have repeatedly searched his smart phone when he returns from abroad.
Khaki's story joins other reports in the past few years of U.S. customs officials searching laptops, cellphones and digital cameras in the name of security. In April, the 9th U.S. Circuit Court of Appeals upheld the constitutionality of border searches of electronics in a child pornography case.
"I've had to unlock my phone and show them my scheduled tasks, calendar and contacts," said Khaki, 50, a corporate executive who has been a U.S. citizen since leaving England 23 years ago.
Customs officials say that electronic storage media are the places where they can find evidence of criminal enterprise — such as child pornography or money laundering. Such media are also where vital data of a traveler's life are kept, such as health records, financial documents, passwords, contracts and memoranda.
"Under the U.S. Constitution, a warrant is needed to search a physical space, such as an office," said Susan Gurley, a spokeswoman for the Association of Corporate Travel Executives. "Yet, the warrantless and unanticipated seizure of one's mobile office has been allowed."

Man Sentenced For Stealing Dog, Blowing Pot Smoke In Its Face

WHEATON, Ill. -- A Plainfield man has been sentenced to 60 days in the DuPage County Jail for stealing a $1,500 Pomeranian puppy and blowing marijuana smoke into its face until it passed out.
Circuit Judge John Kinsella warned 19-year-old Emanuel Lopez that he would subjected to frequent drug testing while serving 30 months probation after being released from jail.
Lopez pleaded guilty in May to stealing the puppy from a Naperville store. The dog was returned to the store three days later and has since been adopted.
His alleged abuse of the puppy was brought up during Wednesday's sentencing as an aggravating factor in the death.
Kinsella told Lopez the bottom rung of humanity abuses animals for amusement.
